Jonathan Gale's Open Letter To MPs Regarding Bill C-279
Dear MPs,
My name is Jonathan Gale, and I'm a lifeguard for the City of Oshawa. Earlier this year Ontario passed Bill 33, which is extremely similar to C-279, both of which add gender identity and gender expression as protected human rights. At our summer staff training two representatives of the alternative s-xualities community came in and told us because of this, we now have to let men into the women's room, and vice versa. As a lifeguard, if I see a man walking into the ladies room, I can't do a thing about it and must assume his motives are pure. It then becomes the responsibility of children to discern his motives, and call for help if necessary. Standard policy in the GTA is that children age 7+ can go swimming unaccompanied if they pass the swim test, and we often have parents drop off their kids and pick up them up a couple hours later.
Over the summer two of my fellow lifeguards had to call the police because a pedophile was hitting on little boys at a pool and exposing himself to them in the locker room. There is the case in Washington state, where a similar law passed and allowed a man named 'Colleen' to unashamedly expose himself to minors age 6-18 in the change room and sauna at Evergreen College. When their parents called the police they couldn't do anything because it was 'her' right.

There is nothing to stop this from happening in my work place, and the results are bad or worse. I do not want little girls and boys seeing the anatomy of the opposite s-x in the change room, or s-x offenders and pedophiles becoming aware of this and exploiting it for all it's worth. The lack of any definition in C-279 means if a man (98% of s-x crimes are by men) identifies as a woman in any way, he is allowed into the ladies change room without limit. To say it simply won't happen ignores the recent history of this recent issue, the education plans of the LGBT community, and the intelligence of highly motivated s-x offenders.
I do not want to deal with little boys and girls crying because they saw something or something was done to them – there's already enough problems without literally opening the door to s-xual predators.
I believe it was the UN that said “when the rights of two parties conflict, the rights of the weaker must be upheld”. Children are one of the weakest and most vulnerable parties in our society.
Please do not let bill C-279 pass.

I am very concerned about this bill which is to add “gender identity” into the Canadian Human Rights Act and the Criminal Code.
What is “gender identity”? It has never been defined by the law. So how do I know when or what I do would I violate this bill when it becomes law?
Mr. Randall Garrison told Xtra.ca that “once gender identity is in the Human Rights Code, the courts and human rights commissions will interpret what that means”. (Please read the link to the article below.) Mr. Garrison purposely left the term “gender identity” undefined to let law-abiding citizens get trapped with a legal case in order for the court to define the term. It is totally unfair to an ordinary citizen like me, and it is a very irresponsible for Mr. Garrison to table such a bill.

I am a female. I would like to ask you to assure me that my privacy is protected when I use a public washroom or an open shower facility in a community centre after swimming.
I am referring to Bill C-279 which adds “gender identity” into the Canadian Human Rights Act and the Criminal Code. I am wondering what “gender identity” legally means. According to literatures by GLBTQ lobbying groups, “gender identity is linked to an individual’s intrinsic sense of self and their sense of being female, male, a combination of both, or neither regardless of their biological sex.”
So it is a sense, a feeling to be the gender of an individual, whether the individual himself or herself is a man or a woman, or appears to be so. My problem is when a man feels or senses himself to be a woman and uses the open shower area of a swimming facility, how can I be protected from the embarrassment of having a naked man showing next to me? If I report the situation to the staff of the swimming facility, can the staff take any action without violating the Human Rights Acts since the man claims his gender identity to be a woman at that moment? How can you tell if this is truly the individual’s “intrinsic sense of self” which justifies him for using a woman’s public shower facility?
This bill, if becomes law, will certainly generate a lot confusions in our society. Please read the news articles to know what happened south of our border. Police and college authority refuse to stop a naked man walking in girls locker room. All they do is to hang curtains and tell the girls to get change behind them. So this bill allows a man with his sense of being a woman to have legal access to a woman’s washroom. I would like to know what is provided to ensure that a little girl feels safe when she is using a washroom without having to worry the presence of a man who claims he senses to be a woman peeking through the crack of the stall she is using. I am not implying that a transgender man is a sexual predator, but what is there to prevent a sexual predator from taking advantage of this bill claiming his gender identity to be a woman to gain access to a woman’s washroom?

Some may argue that more gender-neutral washrooms or a third washroom for gender-variant people will solve the problem. But it is claimed that gender identity is linked to an intrinsic sense of self and their sense of being a female or male. What happens if this individual feels discriminated and refuses to use a gender-neutral or gender-variant washroom?
