On behalf of the owner of XXX Street, please see the attached letter outlining that the Landlord is not prepared to remove subject conditions on the offer to lease pertaining to unit #101. Therefore, the offer to lease is null and void. I will return your deposit to you within five (5) business days.
9. Landlord¡¯s Condition Precedent: The obligations of the Landlord in this Offer to Lease are conditional upon the Landlord satisfying itself as to the following:
(a) Review and approval of the costs associated with completing Landlord¡¯s Work;and
(b) The Landlord¡¯s review and approval of the Tenant¡¯s financial strength and covenant.
These conditions are for the sole benefit of the Landlord and may be satisfied or waived in writing within ten (10) business days of conditional acceptance of this Offer to Lease. Should these conditions not be satisfied by the specified time and date, this Offer to Lease shall be null and void, the parties shall have no further obligation to each other hereunder, and any deposits
shall be returned in full to the Tenant.
